Storage duration

Unless a more specific storage period has been specified in this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial retention periods); in the latter case, the deletion will take place after these reasons cease to apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6 Para. 1 lit. a GDPR or Art. 9 Para. 2 lit. a GDPR, provided special categories of data are processed according to Art. 9 Para. 1 GDPR. In the event of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49 Para. 1 lit. a GDPR. If you have consented to the storage of cookies or the access to information on your device (e.g., via device fingerprinting), the data processing is additionally based on § 25 Para. 1 TDDDG. Consent can be revoked at any time. If your data is necessary for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 Para. 1 lit. b GDPR. Furthermore, we process your data if this is necessary to fulfill a legal obligation on the basis of Art. 6 Para. 1 lit. c GDPR. Data processing may also be based on our legitimate interest according to Art. 6 Para. 1 lit. f GDPR. Information about the relevant legal bases in each individual case is provided in the following paragraphs of this privacy policy.

Information on data transfer to third countries that are not secure under data protection law and transfer to US companies that are not DPF-certified

Among other things, we use tools from companies based in third countries that are not secure under data protection law as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). If these tools are active, your personal data can be transferred to these countries and processed there. We point out that no level of data protection comparable to that of the EU can be guaranteed in third countries that are insecure under data protection law.

We point out that the USA, as a secure third country, fundamentally has a level of data protection comparable to that of the EU. A data transfer to the USA is therefore permissible if the recipient holds a certification under the "EU-US Data Privacy Framework" (DPF) or has suitable additional guarantees. Information on transfers to third countries, including data recipients, can be found in this privacy policy.

Recipients of personal data

Within the scope of our business activities, we work with various external entities. In some cases, it is also necessary to transmit personal data to these external entities. We only pass on personal data to external entities if this is required in the context of the fulfillment of a contract, if we are legally obligated to do so (e.g., transferring data to tax authorities), if we have a legitimate interest according to Art. 6 Para. 1 lit. f GDPR in passing it on, or if another legal basis allows the data transfer. When using processors, we only share our customers' personal data on the basis of a valid contract for order processing. In the case of joint processing, a joint processing agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out before the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

If the data processing takes place on the basis of Art. 6 Para. 1 lit. e or f GDPR, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can prove compelling legitimate grounds for the processing that outweigh your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims (objection according to Art. 21 Para. 1 GDPR).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is connected with such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection according to Art. 21 Para. 2 GDPR).

Right of appeal to the competent supervisory authority

In the event of violations of the GDPR, the data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a standard, machine-readable format. If you require the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction, and deletion

Within the framework of the applicable legal provisions, you have the right to free information about your stored personal data, its origin and recipient, and the purpose of data processing at any time, and, if necessary, a right to correct or delete this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data occurred/is occurring unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have filed an objection pursuant to Art. 21 Para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
  • If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or to assert, exercise, or defend legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising e-mails

We hereby object to the use of contact data published within the scope of the imprint obligation for sending advertising and informational materials not expressly requested. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam e-mails.

2. Hosting

We use the following provider(s) for hosting the content of our website:

Shopify

The provider is Shopify International Limited, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter "Shopify").

Shopify is a tool for creating and hosting websites. When you visit our website, Shopify records your IP address as well as information about the device and browser you are using. Furthermore, Shopify analyzes the number of visitors, the sources of visitors, and customer behavior, and creates user statistics. When you make a purchase on our website, Shopify also records your name, e-mail address, delivery and billing addresses, payment data, and other data associated with the purchase (e.g., phone number, amount of sales made, etc.). Shopify stores cookies in your browser for the analyses.

For details, please refer to Shopify's privacy policy: https://www.shopify.de/legal/datenschutz.

The use of Shopify is based on Art. 6 Para. 1 lit. f GDPR. We have a legitimate interest in the most reliable presentation of our website possible. If appropriate consent has been requested, processing takes place exclusively on the basis of Art. 6 Para. 1 lit. a GDPR and § 25 Para. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's end device (e.g., device fingerprinting) within the meaning of the TDDDG. This consent can be revoked at any time.

Order processing

We have concluded a contract for order processing (AVV) for the use of the above-mentioned service. This is a contract mandated by data protection law, which guarantees that they process the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

3. Web tracking and Analytics

Cookies

Our internet pages use so-called "cookies". Cookies are small data packets and do not cause any damage to your end device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your end device until you delete them yourself or an automatic deletion is performed by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g., cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions you have requested (e.g., for the shopping cart function), or to optimize the website (e.g., cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6 Para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of their services. If consent for the storage of cookies and comparable recognition technologies was requested, processing occurs exclusively on the basis of this consent (Art. 6 Para. 1 lit. a GDPR and § 25 Para. 1 TDDDG); the consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for specific cases or in general, and activate the automatic deletion of cookies when closing the browser. The functionality of this website may be restricted if cookies are deactivated.

You can find out which cookies and services are used on this website in this privacy policy.

We use the following provider(s) for data collection using cookies:

Shopify

Shopify sets technically necessary cookies that are required for the proper functioning of the online shop. In particular, these cookies enable basic functions such as the provision of the shopping cart, the execution of the ordering and checkout process, the storage of privacy settings, as well as security and session functions.

The storage of or access to these technically necessary cookies takes place on the basis of § 25 Para. 2 No. 2 TDDDG, insofar as the cookies are absolutely necessary to provide a service expressly requested by you. Insofar as personal data is processed here, the processing – depending on the respective purpose – takes place on the basis of Art. 6 Para. 1 lit. b GDPR for the execution of pre-contractual measures or for the fulfillment of a contract or on the basis of Art. 6 Para. 1 lit. f GDPR due to our legitimate interest in a secure and functional online shop.

In the context of using Shopify, personal data may be processed outside the European Economic Area, particularly in Canada and the USA. Shopify uses appropriate protection mechanisms for such international data transfers, in particular Binding Corporate Rules approved by European data protection authorities and, if applicable, standard contractual clauses.

4. Data collection through user interactions

Inquiry by e-mail, phone or fax

If you contact us by e-mail, phone, or fax, your inquiry including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, provided your request is related to the fulfillment of a contract or is necessary for carrying out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR) if this was requested; consent can be revoked at any time.

The data you sent to us via contact requests will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after the processing of your concern is completed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions.

The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after the processing of your inquiry is completed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Registration on this website

You can register on this website to use additional functions on the page. We only use the data entered for this purpose for the use of the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

For important changes, for example to the scope of the offer or in the case of technically necessary changes, we use the e-mail address specified during registration to inform you in this way.

The processing of the data entered during registration is carried out for the purpose of implementing the user relationship established by the registration and, if necessary, for initiating further contracts (Art. 6 Para. 1 lit. b GDPR).

The data recorded during registration will be stored by us for as long as you are registered on this website and will then be deleted. Statutory retention periods remain unaffected.

Instant Messaging Service

We use the following provider(s) for communication via instant messaging service:

WhatsApp

For communication with our customers and other third parties, we use the instant messaging service WhatsApp, among others. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. However, WhatsApp gains access to metadata that arises during the communication process (e.g., sender, recipient, and time). We also point out that WhatsApp, according to its own statement, shares personal data of its users with its US-based parent company Meta.

Further details on data processing can be found in WhatsApp's privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.

The use of WhatsApp is based on our legitimate interest in the fastest and most effective communication possible with customers, interested parties, and other business and contractual partners (Art. 6 Para. 1 lit. f GDPR). If appropriate consent has been requested, data processing takes place exclusively on the basis of the consent; this can be revoked at any time with effect for the future.

The communication content exchanged between you and us on WhatsApp remains with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after the processing of your inquiry is completed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

The company has a certification under the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. For more information, please refer to the provider under the following link: https://www.dataprivacyframework.gov/participant/7735.

We use WhatsApp in the "WhatsApp Business" variant.

Data transmission to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.

We have set up our WhatsApp accounts so that it does not make an automatic data comparison with the address book on the smartphones in use.

Order processing

We have concluded a contract for order processing (AVV) for the use of the above-mentioned service. This is a contract mandated by data protection law, which guarantees that they process the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

Audio and video conferences

Data processing

We use online conference tools, among other things, to communicate with our customers. The specific tools we use are listed below. If you communicate with us via video or audio conference on the internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide/use to use the tools (e-mail address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants, and other "contextual information" related to the communication process (metadata).

Furthermore, the provider of the tool processes all technical data required to handle the online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded, or made available in any other way within the tool, this will also be stored on the servers of the tool providers. Such content includes in particular cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.

Please note that we do not have complete influence over the data processing procedures of the tools used. Our capabilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the tools used, which we have listed below this text.

Purpose and legal basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Para. 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and speed up communication with us or our company (legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR). If consent has been requested, the relevant tools are used on the basis of this consent; the consent can be revoked at any time with effect for the future.

Storage duration

The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory retention periods remain unaffected.

We have no influence over the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.

5. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the provided e-mail address and that you agree to receive the newsletter. Further data is not collected or only collected on a voluntary basis.

6. Handling of applicant data

Application process

We offer you the opportunity to apply to us (e.g., by e-mail, postal mail, or via online application form). In the following, we inform you about the scope, purpose, and use of your personal data collected as part of the application process. We assure you that the collection, processing, and use of your data takes place in accordance with applicable data protection law and all other statutory provisions and that your data will be treated with strict confidentiality.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes in the context of interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG according to German law (initiation of an employment relationship), Art. 6 Para. 1 lit. b GDPR (general contract initiation), and – provided you have given your consent – Art. 6 Para. 1 lit. a GDPR. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 Para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

Retention period of the data

If we are unable to offer you a job, you reject a job offer, or withdraw your application, we reserve the right to retain the data you submitted on the basis of our legitimate interests (Art. 6 Para. 1 lit. f GDPR) for up to six months from the end of the application process (rejection or withdrawal of the application). Afterwards, the data will be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the six-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further retention no longer applies.

A longer storage period can also take place if you have given your explicit consent (Art. 6 Para. 1 lit. a GDPR) or if statutory retention obligations preclude deletion.

7. Information for business partners

Purpose of processing and type of personal data

In the course of our business activities, we process and store personal data of business partners (e.g., interested parties, customers, suppliers). We also store your contact data, which you have provided to us, in our systems in order to enable further contact with you. Below you will find information about the individual processing purposes.

Processing of personal data of interested parties

If you are interested in our services or products and contact us in writing or by phone for this purpose, we process your personal data in order to answer your inquiry and, if requested, to send you informational material. In the event that a contract is subsequently concluded with you, we will process your data on the basis of this contract.

The legal basis is Art. 6 Para. 1 lit a) GDPR, Art. 6 Para. 1 lit b) GDPR.

Processing based on a customer relationship

If you are a customer of ours, we process your personal data for the purpose of contract initiation (e.g., preparation of offers), contract execution, as well as for the implementation of pre- and post-contractual measures.

The legal basis here is Art. 6 Para. 1 lit b) GDPR.

We reserve the right to conduct customer satisfaction surveys among our existing customers, to invite you to events and trade fairs, to send you customer magazines, and to record the progress of the customer relationship in our systems. We have a legitimate interest in continuously improving and further consolidating our customer relationship.

The legal basis here is our legitimate interest according to Art. 6 Para. 1 lit f) GDPR.

We manage you as an existing customer, provided you have concluded a contract with us. Your contact data will be processed here to send you information electronically (e.g., in the form of a newsletter) about new products.

You can object to the processing of your personal data for this purpose at any time. Simply send your revocation to the contact options mentioned under section 1.

The legal basis here is our legitimate interest according to Art. 6 Para. 1 lit f) GDPR.

In the event of a warranty claim, we process your personal data. This is necessary to be able to fulfill the warranty claims. We also permissibly use this data for postal contact to be able to inform you about current topics, e.g., product recalls, expansions of your system, and discontinuations.

The legal basis here is Art. 6 Para. 1 lit b), f) GDPR.

Furthermore, we are subject to various legal obligations according to which we must process your data. This includes tax requirements or anti-terror and sanctions list screening of our customer contacts.

We may also process your personal data to inform you about current products, events, and other topics if you have given us your consent to do so.

The legal basis here is your consent according to Art. 6 Para. 1 lit a) GDPR.

Origin of the data

We collect the personal data directly from you when you provide it to us due to a contract initiation, a contractual relationship, or personal contact, e.g., at trade fairs.

However, we also obtain personal data from publicly accessible sources, such as company websites or public databases such as www.gelbe-seiten.de. We process this data in order to be able to contact you.

Recipients of the data

We only transmit your personal data to third parties if we are legally obligated to do so, if this is necessary to fulfill a contractual obligation with you, to service providers with whom an order processing agreement according to Art. 28 GDPR exists, or if you have consented.

A transmission to third countries does not take place without your consent unless we are legally obligated to do so or this is necessary for the execution of the contract.

Duration of storage

Your personal data will only be stored for as long as knowledge of the data is required for the purposes of the customer relationship or the purposes for which it was collected, or if legal or contractual retention rules exist.

Various statutory retention periods arise, among other things, from tax regulations and extend up to ten years for tax-relevant documents and receipts. After the retention period, the data is deleted in compliance with data protection laws.
