Notice Regarding Data Transfer to Third Countries That Are Not Secure Under Data Protection Law and Transfer to US Companies That Are Not DPF-Certified

Among other things, we use tools from companies based in third countries that are not secure under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to these countries and processed there. We point out that in third countries that are not secure under data protection law, no level of data protection comparable to that of the EU can be guaranteed.

We point out that the USA, as a safe third country, generally offers a level of data protection comparable to that of the EU. A data transfer to the USA is permissible if the recipient has certification under the "EU-US Data Privacy Framework" (DPF) or has suitable additional guarantees. Recipients of Personal Data

As part of our business activities, we work with various external bodies. In some cases, a transfer of personal data to these external bodies is also required. Audio and Video Conferences

Data Processing

We use online conference tools, among other things, to communicate with our customers. The specific tools we use are listed below. If you communicate with us via video or audio conference over the Internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide/use to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants, and other "contextual information" related to the communication process (metadata).

Furthermore, the provider of the tool processes all technical data required to handle online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded, or otherwise made available within the tool, it will also be stored on the servers of the tool providers. Such content includes in particular cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during use of the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options depend largely on the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the respective tools used, which we have listed below this text.

Purpose and Legal Bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Para. 1 lit. b GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR). Insofar as consent was requested, the tools concerned are used on the basis of this consent; consent can be revoked at any time with effect for the future.

Storage Period

The data collected directly by us via video and conference tools will be deleted from our systems as soon as you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Newsletter Data

6.  Handling Applicant Data

Application Process

We offer you the opportunity to apply to us (e.g. by email, post, or via online applicant form). In the following, we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data takes place in accordance with applicable data protection law and all other statutory provisions and that your data will be treated strictly confidentially.

Scope and Purpose of Data Collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6 Para. 1 lit. b GDPR (general contract initiation), and – if you have given consent – Art. 6 Para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 Para. 1 lit. b GDPR for the purpose of implementing the employment relationship.

Retention Period of Data

If we cannot make you a job offer, you reject a job offer, or withdraw your application, we reserve the right to retain the data transmitted by you on the basis of our legitimate interests (Art. 6 Para. 1 lit. f GDPR) for up to six months from the end of the application process (rejection or withdrawal of the application) with us. The data will then be deleted and physical application documents destroyed. Storage serves in particular for evidentiary purposes in the event of a legal dispute. If it is evident that the data will be required after the expiration of the six-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further retention no longer applies.

Purpose of Processing and Type of Personal Data

In the course of our business activities, we process and store personal data of business partners (e.g. interested parties, customers, suppliers). If a contract is subsequently concluded with you, we process your data on the basis of this contract.

Processing Based on a Customer Relationship

If you are a customer of ours, we process your personal data for the purpose of contract initiation (e.g. quote creation), contract performance, and for implementing pre- and post-contractual measures.

The legal basis for this is Art. 6 Para. 1 lit. b GDPR.

We reserve the right to conduct customer satisfaction surveys among our existing customers, invite you to events and trade fairs, send you customer magazines, and record the history of the customer relationship in our systems. Here we have a legitimate interest in continuously improving and strengthening our customer relationship.

The legal basis for this is our legitimate interest pursuant to Art. 6 Para. 1 lit. f GDPR.

We consider you an existing customer insofar as you have concluded a contract with us. Your contact details will be processed to send you information electronically (e.g. in the form of a newsletter) about new products.

Processing Based on Consent

If you have given consent, we store your contact details in our systems even if there is no current contractual relationship with you. We then use this data to contact you at a later point in time.

We may also process your personal data to inform you about current products, events, and other topics if you have given us consent to do so.

Origin of Data 

We collect personal data directly from you when you provide it to us due to contract initiation, a contractual relationship, or personal contact, e.g. at trade fairs.

However, we also obtain personal data from publicly available sources, such as company websites or public databases such as www.gelbe-seiten.de. We process this data to be able to contact you.

Recipients of Data

We only transfer your personal data to third parties if we are legally obligated to do so, if this is necessary to fulfill an existing contractual obligation with you, to service providers with whom data processing exists pursuant to Art. 28 GDPR, or if you have consented.

A transfer to third countries does not take place without your consent, unless we are legally obligated to do so or this is necessary to execute the contract.

Duration of Storage

Your personal data will only be stored for as long as knowledge of the data is necessary for the purposes of the customer relationship or the purposes for which it was collected, or if statutory or contractual retention regulations exist.

Different statutory retention periods arise, among other things, from tax regulations and extend up to ten years for tax-relevant documents and records. After the retention period, the data is deleted in compliance with data protection laws.
